Our patent attorneys, Masahiro Nanjo, Ayako Seta, and Koichiro Iha, acted on behalf of and assisted the defendant in a damages action before the Tokyo District Court (Case No. Reiwa 2 (Wa) No. 8642) based on antibody-related patents (Japanese Patent Nos. 5,705,288 and 5,906,333). The Tokyo District Court dismissed the plaintiff’s claims, finding that the patents are invalid due to violations of the support requirement and the enablement requirement (Judgment dated September 28, 2023). The plaintiff appealed to the Intellectual Property High Court (Case No. Reiwa 5 (Ne) No. 10107) against the Tokyo District Court’s judgment dismissing the plaintiff’s claims.

As a result, the Intellectual Property High Court dismissed the appeal, holding that the patents are invalid due to a violation of the support requirement (Judgment dated January 29, 2025).
